Terese Arenth is a Partner with the firm and serves as Chair of its Marketing, Advertising & Promotions Practice Group and Co-Chair of its Privacy, Cybersecurity & Technology Practice Group. Ms. Arenth concentrates her practice in promotional marketing, advertising and Internet/new media, as well as privacy and technology related matters. She also has significant involvement in the firm’s intellectual property practice area and vast experience in commercial and corporate litigation.
As a recognized leader in her field, Ms. Arenth’s substantial experience in the firm’s regulatory, promotional marketing and advertising matters involves all aspects of direct marketing programs and promotions, with an emphasis on sweepstakes, contests, social media promotions, digital marketing, cause-related marketing, telemarketing, and loyalty programs. She regularly counsels clients with regard to sweepstakes, contests and promotion rules and regulatory compliance, advertising collateral review, TCPA compliance, CAN-SPAM compliance, endorsements, influencers, negative option marketing and the negotiation and drafting of promotion-related agreements such as sponsorship agreements, vendor agreements, publicity releases and spokesperson, brand ambassador, and talent agreements. She also handles a variety of licensing, distribution and general corporate, privacy and technology matters, primarily in connection with sponsorship, licensing and distribution agreements, privacy policies, terms of use, COPPA compliance, advising on the Americans with Disabilities Act (ADA), and compliance with cybersecurity, privacy and communications laws. Ms. Arenth handles complex arbitrations and litigation in both State and Federal Courts, focusing on TCPA claims, ADA website compliance claims, business disputes, trademark, copyrights and unfair competition and domain name disputes.
Prior to joining the firm in 1996 and becoming a partner in 2001, Ms. Arenth began her career at two prestigious Manhattan law firms, where she concentrated her practice in commercial, corporate and intellectual property litigation.

Affiliations
Ms. Arenth is an active member of the Association of National Advertisers (ANA) and Brand Activation Association (BAA) (f/k/a Promotion Marketing Association), as well as their Government and Legal Affairs Committee. She is also a member of the Intellectual Property Law Section of the American Bar Association, where she is a member of its Marketing Interface Committee (f/k/a Promotion & Marketing Law Committee), having previously served two terms (2011-2013) as its Chair and four terms (2009-2011 and 2019-2021) as its Vice-Chair. Ms. Arenth regularly serves as a speaker and author on various advertising, marketing and intellectual property law-related topics, including having served as a speaker and contributing author in connection with Aspatore’s “Inside the Mind” series on Recent Developments in Advertising Law, the BAA/ANA’s Annual Law Conference and its Promotion & Marketing Law Book treatise, the ABA’s Annual Review of Intellectual Property Law Developments (2009; 2010), the trademark chapter of the ABA’s Guide for In-House Counsel reference book (2019) and the Journal of Internet Law (2019).
Ms. Arenth serves as a member of the New York City Bar Association, as well as the Nassau County Bar Association, participating in the Intellectual Property; Sports, Entertainment and Media Law; and Commercial Litigation Committees. For many years, Ms. Arenth sat on the Advisory Board for the non-profit organization Moms Who Kick Inc., as well as the Advisory Board for The Women’s Financial Group (TWFG), previously serving on its Board of Directors for several years, in addition to then serving as Chair of its membership committee.
