Michael Kwiatkowski

Michael Kwiatkowski concentrates his practice in all facets of creditors’ rights, restructuring and bankruptcy related matters. Mr. Kwiatkowski advises and represents a wide variety of creditors in all aspects of bankruptcy, including corporate reorganization, bankruptcy-related litigation, creditors’ rights, and out of court debt restructuring. He also advises lenders on workout matters and has extensive experience in representing financial institutions in commercial litigation matters, including contested commercial mortgage foreclosures.

Mr. Kwiatkowski works with his lending clients to create strategies tailored to meet their business objectives and maximize recovery in connection with distressed loans. His experience includes preparing and prosecuting pleadings and motions, negotiating workout agreements and out-of-court settlements, and appearing at contested hearings in commercial mortgage foreclosures on various motions, including motions to appoint property receivers and motions for summary judgment.  He has also handled numerous avoidance actions in bankruptcy cases.

During law school, Mr. Kwiatkowski served as an intern to the Honorable Jerome Feller of the United State Bankruptcy Court for the Eastern District of New York and the Honorable Bernard J. Fried of the Commercial Division of the New York State Supreme Court.  He also interned with the United States Attorney’s Office for the Eastern District of New York.

Mr. Kwiatkowski is admitted to practice in New York and New Jersey, as well as before the United States District Courts for the Southern and Eastern Districts of New York and the United States District Court for the District of New Jersey.

Mr. Kwiatkowski is a member of the Chapter 11 Lawyers’ Advisory Committee for the Eastern District of New York Bankruptcy Court. He is also a member of the Board of Directors of the Turnaround Management Association – Long Island (TMA-LI) and a member of the American Bankruptcy Institute.
