MHH Defeats DOH’s Motion To Dismiss Article 78 Proceeding
Peter Zlotnick, Ted Berkowitz, Stephen Ginsberg and Alexander Litt recently scored a major victory for a managed long-term care plan client in an Article 78 proceeding against the New York State Department of Health (DOH) regarding its decision to freeze the risk score it uses to determine the partial capitation and nursing home transition rates charged to its members.
