Brian A. Bloom is a Partner of the firm where he serves as Co-Chair of its Intellectual Property Practice Group.  Mr. Bloom has over 20 years of experience in handling all facets of complex litigation, intellectual property and licensing matters.

The scope of his practice is diversified, and includes counseling emerging brands and Fortune 500 companies, telecommunication companies, pharmaceutical companies, major record companies’ merchandising affiliates, photographers and authors with respect to a diverse range of intellectual property prosecution and litigation matters. Mr. Bloom also represents large and small merchandising companies with respect to entertainment related litigation and complex corporate transactions involving intellectual property issues.  His practice includes the representation of a variety of clients in civil litigation involving claims of copyright and trademark infringement, counterfeiting, trade dress, false advertising, unfair competition, non-compete/non-solicitation rights of publicity, privacy, and defamation.   Mr. Bloom has defended class action complaints alleging TCPA, ADA, Prop 65, privacy and security violations.  He has also pursued cybersquatters in federal court, ICANN arbitration proceedings, and in complex WIPO actions.

In addition, Mr. Bloom counsels clients in regard to the risk assessment issues of trademark and copyright use and licensing, franchise agreements, on-line business operation, branding, marketing partnerships and sponsorship agreements. Mr. Bloom counsels and assists clients with new media issues involving social media platform hacking and verification issues. He negotiates and drafts a variety of agreements including developer agreements, work-for-hire agreements, buy-sell agreements, recording, software license, joint venture, trademark licensing, film finance and option, and reality television participation and development agreements.  Mr. Bloom also has a sophisticated copyright and international trademark filing and prosecution practice before the United States Copyright Office (USCO) and the United States Patent and Trademark Office (USPTO) as well as the Trademark Trial and Appeal Board (TTAB).

He also regularly lectures and writes on a myriad of intellectual property privacy and new media issues.

Mr. Bloom is admitted to practice in New York.  He is also admitted before the U.S. District Courts for the Eastern, Western, Southern and Northern Districts of New York, as well as the District of Columbia and the Second Circuit Court of Appeals.

Affiliations

Mr. Bloom is a member of the American Bar Association, the New York Bar Association’s Committee on Entertainment, Arts and Sports Law, and the Nassau County Bar Association.  He is an active member of the Copyright Society of the United States of America and also serves as an Executive Board Member of the music and entertainment committee of the City of Hope.
