The Creditors’ Rights and Bankruptcy Group is the original cornerstone of the firm and remains one of its highly prominent practice areas. On behalf of our banking, financial, real estate, venture capital investor, and equipment leasing clients, we pride ourselves on the aggressive enforcement of the rights and remedies with respect to secured and unsecured transactions. These include collection, replevin, fraudulent conveyance and sophisticated enforcement of judgments.
This Group also offers outstanding experience and skills in the reorganization, restructuring or liquidation of financially troubled companies under both federal bankruptcy and state insolvency laws in cases pending in courts throughout the North East and parts of the Mid West. Services rendered include a complete range of bankruptcy representation, including Chapter 11 reorganizations and sales, Chapter 11 and 7 liquidations, and the restructuring of debt through out-of-court workouts. Attorneys in the Group are experienced in representing secured lenders, equipment lessors, landlords, bankruptcy trustees, creditors’ committees and debtors in bankruptcy proceedings. Members of the firm have also served as trustees, examiners and other court-appointed positions.

- Representation of the official committee of unsecured creditors in a bankruptcy of an investment trust arising out of a Ponzi scheme
- Representation of the first mortgage lender in groundbreaking law in one of NY’s first time-share bankruptcy proceedings (In re Gurneys Inn)
- Representation of unofficial group of equipment lessors in the out-of-court restructuring for Silicon Valley manufacturer, IC Works
- Bankruptcy counsel for a publicly-traded company which, prior to its filing, was one of the largest manufacturers of vitamins in the country
- Bankruptcy counsel to both the Chapter 11 and Chapter 7 trustee in a liquidation of a well known Long Island carting company
- Representation of a group of investors who purchased the property, business and assets of a dining, catering and concert venue in Long Island, New York
- Represented secured lender in Delaware bankruptcy case in connection with structured bid on 363 asset sale, partnering with bidder to support bid and arrange equity participation and securities law compliance for client’s stock received in bidder
