Our Landlord/Tenant group represents commercial and residential landlords, co-op and condo boards, tenant associations, and tenants including proprietary lease tenants, in their disputes over rent, lease violations, privacy, nuisance, repairs, security, lease terms and other issues.
Additionally, on behalf of landlords, our attorneys regularly appear before the New York City Civil Court, New York State Supreme Court, the United States Bankruptcy Court and the New York State Division of Housing and Community Renewal (DHCR), the agency responsible for implementing the laws and regulations that govern rent-controlled and rent-stabilized tenancies.
Some of the services we provide in this area include the prosecution of luxury decontrol proceedings, defense of rent registration disputes, defense of rent overcharge complaints, defense of fair market rent appeals, defense of tenant-initiated complaints regarding reduction of services, and defense of harassment challenges.
We also defend and challenge Administrative Ruling by Petition for Administrative Review (PAR), as well as Article 78 proceedings in the United States Supreme Court.
Furthermore, we appear before, and defend against code violations issued, by the Department of Buildings, the Department of Sanitation, the Department of Environmental Protection and the New York City Fire Department. In this regard, we appear on behalf of our clients before the Environmental Control Board and New York City Criminal Court.
